Krispkut Coupon – Terms and Conditions

The “$1.00 off Krispkut products coupon” (“Coupon”) has been produced by Snap Fresh Foods 2010 LP (“Snap Fresh”).  The following terms and conditions apply to the use of the Coupon:

1.The Coupon may only be redeemed at Countdown, Woolworths or Foodtown stores in New Zealand that stock Krispkut products (“Stores”).  The Coupon may not be redeemed on Krispkut fruit salads.  The Coupon may not be redeemed through online shopping on any websites for the Stores.

2.The Coupon is only valid until the expiry date shown on the Coupon or, in the event of any error on the Coupon, such alternative date as may be as may be notified by Snap Fresh on the website www.krispkut.co.nz.  In no circumstances shall any Coupon be valid past 30 June 2012.   

3.Only one Coupon may be used per Krispkut product purchased per transaction.  The Coupon has a unique identification code and, once the Coupon has been redeemed, it is no longer valid.  The Coupon must be surrendered on use.  

4.The Coupon may only be used in connection with normal, retail purchases of Krispkut products and not in connection with any trade or commercial purchases.  Compliance with this condition shall be determined by the Stores in their sole discretion.    

5.The Coupon may not be used in conjunction with any other offer, coupon or special deal unless otherwise specified by the Stores.  

6.The Coupon cannot be exchanged, refunded, replaced or redeemed for cash.  

7.The Coupon is personal to the holder and must not be assigned, reproduced, sold or traded.  

8.The Coupon is the sole responsibility of the holder.  Neither Snap Fresh nor the Stores are responsible for damaged, lost or stolen Coupons.  

9.Snap Fresh shall not be liable for a failure or delay in performance where such failure or delay is caused by Act of God (such as fire, flood or earthquake), state of emergency, war, Act of Parliament, governmental or regional or local authority restraint, legislation or bylaw, strike, industrial action, lockout, difficulty in procuring components or materials, technical difficulties or interference, equipment malfunction, shortage of labour, lack of skilled labour, delays in transit, failure or delays by suppliers or subcontractors, failure, delay or inability to obtain any necessary authorisation, legislative, departmental or other prohibition or restrictions, legal action, injunction or threat or reasonably anticipated threat of injunction or other legal action by any person or other causes whatsoever (whether similar in nature or not to the foregoing) beyond Snap Fresh’s reasonable control (“Force Majeure Event”).

10.Snap Fresh reserves the right to cancel, terminate, modify or suspend or recommence this promotion at any time irrespective of the expiry date shown on any Coupon including, without limitation, if for any reason the promotion is interfered with or disrupted due to a Force Majeure Event.  Any such cancellation, termination, modification, suspension or recommencement shall be notified on the website www.krispkut.co.nz.  

11.To the fullest extent permitted by law, all warranties, descriptions, representations and conditions as to fitness, suitability for any purpose or otherwise, whether of a like nature or not, and whether expressed or implied by law, trade custom or otherwise, are expressly excluded.

12.To the fullest extent permitted by law, Snap Fresh’s total liability, whether for breach of these conditions or in negligence or in any other tort or for any other common law or statutory cause of action arising in relation to the Coupon, is limited to $1.

13.To the fullest extent permitted by law, Snap Fresh will not be liable for any incidental, consequential or indirect damages, loss of profits, loss of goodwill or reputation, loss of bargain, loss of opportunity or loss of anticipated savings howsoever arising, whether based on warranty, contract, tort, negligence or any other legal theory, or whether or not the party knew of the possibility of such loss or damage.
